E. Seminary man charged for backyard shooting
Remember this? A homeowner wakes up and finds a man attempting to break into his garage and confronts/shoots him with a shotgun?
Originally charged with unlawful wounding, which is a felony, the homeowner put in a plea of “recklessly handling a firearm.” His judge, however, was partially sympathetic saying, “If I saw this in my backyard, I don’t know what I would do.”
The original response to the story on North Richmond News was split between strong support of the homeowner and strong opposition. One commenter said:
Homeowner’s word versus jackass would be robber with new piercings. Homeowner wins.
While another:
What he did was probably illegal under VA penal law, given that self-defense laws require an affirmative defense, that is, the defendant “must reasonably fear death or serious bodily harm to himself at the hands of his victim.”





Interesting to see the outcome of this story. I would have probably been in the same shoes had this occured in my back yard at 3am, inside my 9ft. fence.
Ross work hard for everything he has? Yes, if being on his knees to someone else is called working hard. Question; does the missus know about her man’s frequent ” meetings ” and ” agreements ” he has with that sweet city councelman he’s been seeing on the side.
This just in: A shot gun was fired three times between 8:54 and 9:07 this evening. Each shot was preceeded by a woman’s terrified scream But, not to worry. None of the very important residents of East Semenary were impacted by this incident.

I don’t know, Retrofunk3. I most certainly hope not. I do know that just a few days after the intitial incident, my family and I were driving down through that part of the alley in quetion. ( It being something of a short-cut to get where we needed to be at the time ). We paused to allow someone’s dog to get out of the ally, talking among ourselves and listening to the car radio. We became aware of some -one yelling at us — us, now, who minding our own business, btw — to get the hell out of there. We realized the yelling was coming from behind this exectionally tall wooden fence. Some man was ordering us to leave, and we were stopped in a — presumably — public alley. ( We’re still a little unlcear on who really owns what segments of the city’s alleys ). I mean, come on, now! It’s a PUBLIC alley! People have a right to travel through if they want to. Or, that was the case the last time I checked.
3, vicious rumor has it that some of the residents along E. Semenary do own parts of that alley. Something about them having an ” agreement ” with some of the city’s councelmen. Also, because a couple of said councelmen live on or along E. Semenary, that part of the neighborhood gets a number of ” perks ” that other parts of the city arne’t entitled to. You know, something to do with certain tax-breaks and ” other ” finiancial ” incentives ” for certain ” favors “.
People, that’s harsh! How do you know for certain that Ross didn’t come by his stuff legally? And, do you really think the city would let some residents, regardless of wealth and status, own parts of it’s property?
I think it’s just one person posting under three names.
Where is the proof? Put up or shut up. I can’t beleive that this site does not moderate anymore. These are some really pretty harsh accusations, if I am reading them correctly. And who would want to “own” an alley, anyway?
Dakotamontana you know people have been sued for putting stuff on blogs. Just because this is on the internet you can’t just make statements and not be held responsible for them.
Oh, Scott, you those ignorant sub-burban hicks. They’ll beleive pretty much anything they hear. I for one know that it’s a vicious rumor. The alley thing, that is. Now, in answer to your question, and keep in mind that this is totally tongue-n-cheek when I say this; The reason one would want to own an alley is to block it off from all types of traffic and turn it into a beautiful garden. Or, to place lovely cement flower pots in the middle of the alley.
Retrofunkmom: I hope you cleaned up after that dog. Now, THAT is a law in Richmond.
What mess, David? I never said anything about hitting the dog in question. I did say we had stopped to let the dog get out of the alley so we could contimue to our destinatin. You really need to start paying more attention to what’s being said instead of asuming what you thought you heard. Incidentally, the dog in question trotted into someone’s backyard.
Rfm: My apologies. I did misread your earlier post. My intial reading was that you stopped to let a dog out of your car, not that you stopped for the dog to exit the alley.
I’m so confused by this. Is this a site for News about Richmond’s Northside? Hardly any news is discussed, nothing is moderated, and important events that actually foster and enhance community are completely ignored (i.e. Battery Park & So. Barton Heights’ event this Saturday: Night of Lights).
Why is anyone engaging someone who clearly has multiple accounts and just makes ridiculous claims that have no impact on anything? Why aren’t violent, rude, or aggressive posts blocked? This site doesn’t function like other online “community” forums on blogs.

You are so right. I have been preaching about the lack of a modirator to no avail. I am giving up on this site. It is a complete joke since Ross took over. You can not even contact the site administrator. That feature has been taken down quite a while ago.
E and S, I posted the information on here. I did get a email from Ross asking me to email him the information directly. Which I did and the event information is not posted.
As for the comments I can understand people having a difference of opinion but I don’t think ridiculous comments that refer to a sexually act should not be allowed.
A couple of things:
1. A post is, and has been, scheduled to go up tomorrow at 6:30am featuring the Barton Heights Tour of Lights. The event is this Saturday and I like to post things closer to the event date so people don’t forget about them.
2. Plenty of comments are moderated. The comments that are moderated do not show up on the site, so it would be difficult for you to know it was going on.
3. I emailed all three of the multiple pseudonyms in this thread last night. We’ve talked it over and I’m confident things will be fine from here on out.

People, I’ve spoken to the individuals in question as well. Suffice it to say, the individuals will have to use another computer, preferrable from another location. By the way, any info. on the shooting that occured on Thanksgiving night? It occurred, I think, just a few doors down from me.

I am sure what you say is true about the moderating part, as far as most things are not seen, but your idea of moderating and mine are completely different because Dakotamontana’s comment which is number 2 on this series of comments would not still be posted.
But it’s okay for you, Scott, to show a poster the error of their way. While pretentioulsy pointing out — politely, I might add — the lifestyles of the non-privileged people will have detrimental effects on their already disadvantaged ability to even think for themselves. Personally, I think Ross is doing a splendid job of hosting this web-site. In that, he’s balancing the voices seen in here. Some that are good, some that are not so good. As in yin and yang. All the while, he also presents community news and advents.
Retro–who exactly is being pretentious? You don’t know me, so don’t pretend that you do. I may be one of those non-privileged people that you talk about, and yes I can think for myself. To accuse someone of an affair, is not thinking, or presenting news and advents. This is the end of my comments on this subject.

The Hermatage Road round-a-bout comes to mind. Scott. And what you replied to some of the posters. Also, a shooting just a few doors from where folk — regardless of their status — live isn’t news-worthy, then what is? At least Ross does give people a fair chance to be heard. Otherwise, their voices might be known. Unlike some peopel who would censor them simply because these people aren’t in compliance with approved popular opinion.
Retro–Normally I would not respond to your post, but I am bored today. You are reading something into what I wrote, that is not there. I only commented that some of the comments I would moderate more. There is nothing in DAKOTAMONTANA’s comment that says anything about a shooting. It is an accusation, not an opinion. I do value others opinions, however the comment on here, DAKOTAMONTANA’s comment #2 in these series of comments, holds no value, in my opinion. I value other opinions, and never said that the news posted here was of no value. I simply stated that I would moderate some of the comments more closely. Especially accusations that add no value and could get someone sued for slander, and actually the administrator of this site be held somewhat liable because he let the accusation remain on the site. And looking at the current posts there are now 2 Scotts…of which I did not write the post #14. And one other thing that bothers me about your last comment. If you had a problem with something I said months ago (round about), you should have brought it up at that time….not several months later, but I actually think you have me confused with someone else. But that is another matter completely. Again, I consider this matter closed, but if you want the last word, I understand, and you may have it. But please read what I have stated and not more into it that what it is. It is not that deep.

Oh, my! Elizabeth, you’re right! It was Scudder! I went back and viewed the post. ( I keep copies on file ). I’ll contact Retrofunk3 and let ‘em know. And, don’t be ashamed of yuorself for remembering something. Not your fault some people are — how did retro3 put it? — pretencious towards other people and their views.
By the way, Scott; I spoke with DakotaMontana. DM said that the post was not an opinion, It was an observation. Yeah, DM has a pecular notion on observations. ( DM is not oringinally from around here, so that person has a rather off-color view of city officials ). But at the same time, may actually have a valid point. Maybe. There is — or was — a city councelperson living back on E. Semenary. And Mr. Ross did get by with essentially a slap on the wrist. Had that been a disadvantaged person from a lower class neighborhood without benefit of a very good attorney, that person would have been jailed. So, this does look more than a little intriguing.
I really find it odd that all of these post seem to be tied together somehow. (IE a split personality, if you know what I mean) Richard, I think you hit it on the head! A little research on the internet (all public information) lead back to an apartment address of 4828 Chamberlayne Ave, Richmond, VA 23227-3476. It gives a lot more info than this, like a name, phone number and apartment number, but I won’t go that far. I am not that petty.. Why must you be this way? “just an opinion” Happy Holidays!!!

Something else, here, too. Unless a person has absolutely no access to the internet, and been living, since birth, on some desearted island on another planet,of course their information can be found in public records. That’s why a person’s private records are public.

OK, so I could not resist. It all makes sense to me now. You could say that I had a Eureka moment. Retro-You never told me or even let on that your opinion/observation/accusation was SO BIASED. I just did some research of my own. What a shame, I will never get those 10 minutes of my life back. I think you just proved beyond a doubt everything that I stated. Peopel, these comments are all well and fine. But, and I may be wrong on this, you all might have a pet health problem that might need a vet’s attention. As soon as possible. A friend of mine has three or four cats. All of them are strictly indoor cats. In late Oct., or early Nov., one of the cats got out and was gone for a couple of days. It’s okay, they found the runaway cat a couple of days later. She’s fine. Thing is, this particular cat contracted a bad case of worms and passed them on to the other house cats. People, please take your pets to the vet as soon as posible. Peace and Happy Holidays.
